Chapter 1 General Provisions

Article 2 These regulations shall apply to the production, sale, use, recycling, processing, reuse and supervision and management of agricultural films within the administrative area of the autonomous region.
The term “agricultural film” as mentioned in these Regulations refers to ground covering films (hereinafter referred to as mulch films) and greenhouse films used for agricultural production.
Article 3 The prevention and control of agricultural film pollution should adhere to the principles of government leadership, source control, damage liability, market operation, and public participation.
Article 4 People’s governments at all levels are responsible for the prevention and control of agricultural film pollution within their respective administrative regions, organize, coordinate and supervise relevant departments to perform the supervision and management responsibilities for the prevention and control of agricultural film pollution, Implement the target responsibility system and assessment and evaluation system for agricultural film pollution prevention and control.
Article 5 The agriculture and animal husbandry department of the people’s government at or above the county level is responsible for the supervision and management of the use and recycling of agricultural films, and guides the establishment of recycling, processing and reuse of agricultural films. system and recycling outlets to encourage and guide relevant units and other producers and operators to collect, store, transport, utilize, and dispose of waste agricultural films in accordance with the law to prevent environmental pollution.
The ecological environment department of the people’s government at or above the banner and county level is responsible for the supervision and management of environmental pollution prevention and control during the recycling, processing, and reuse of agricultural films.
The market supervision and administration department of the people’s government at or above the banner and county level is responsible for the quality supervision and management of agricultural film products, guiding producers and sellers to establish production and sales accounts, and investigating and punishing the production and sale of agricultural films that are expressly prohibited by the state or do not meet mandatory national standards in accordance with the law. illegal acts.
The industry and information technology departments of the people’s governments at or above the banner and county level are responsible for guiding the production of agricultural films, promoting energy conservation and emission reduction, clean production, and improving the efficiency of comprehensive utilization of resources.
Domestic waste management departments of people’s governments at or above the banner and county level are responsible for the disposal of waste agricultural films that have entered the rural domestic waste collection, transportation and disposal system.
Chapter 2 Production, Sales and Use
Article 6 It is prohibited to produce, sell, or use agricultural films that are expressly prohibited by the state or do not meet mandatory national standards.
Article 7 People’s governments at or above the banner and county level shall take effective measures to encourage the production, sale, and use of high-strength agricultural films and all-purpose films whose performance is better than the mandatory national standards. Article 8 Agricultural film producers shall abide by national and autonomous region industry regulations on agricultural films.�Funds.
Article 18 People’s governments at or above the banner and county level shall cultivate professional service organizations to carry out mechanized recycling, and provide agricultural film recycling and reuse enterprises, recycling outlets or other organizations Support is provided through various means such as awards instead of subsidies, and policy support is provided in aspects such as land use, water use, electricity use, and finance in accordance with relevant national and autonomous region regulations.

Chapter 4 Safeguard Measures
Article 19 The people’s governments at or above the banner and county level shall include the funds required for the prevention and control of agricultural film pollution in the fiscal budget of the same level.
People’s governments at or above the banner and county level should coordinate central, autonomous region, and league-municipal funds, arrange agricultural film pollution prevention and control funds, strengthen project fund supervision, and ensure that earmarked funds are used exclusively.
Article 20 People’s governments at or above the banner and county level shall establish a grid management system in areas where agricultural films are concentrated and contiguously used, and strengthen agricultural use in adjacent administrative areas. Article 21 The agriculture and animal husbandry, ecological environment, market supervision and management, industry and information technology, public security organs, statistics and other departments of the people’s government at or above the county level shall Strengthen work coordination and cooperation, strengthen informatization construction, establish a normalized joint promotion mechanism, and implement full supervision responsibilities for agricultural films.

Article 23 The market supervision and management department of the people’s government at or above the banner county level shall establish an agricultural film market supervision and management system and conduct regular agricultural film quality supervision and inspections.

Chapter 5 Legal Liability
Article 25 Violations of these Regulations shall be governed by the Law of the People’s Republic of China on the Prevention and Control of Soil Pollution, the Law of the People’s Republic of China on the Prevention and Control of Environmental Pollution by Solid Waste, If relevant national laws and regulations such as the Product Quality Law of the People’s Republic of China have stipulated specific penalties, those provisions shall prevail.
Article 26 In violation of the provisions of these regulations, agricultural film producers fail to establish an agricultural film factory sales record system in accordance with regulations, and sellers fail to establish sales desks in accordance with regulations If the account is not corrected, the market supervision and administration department of the people’s government at or above the banner and county level shall order it to make corrections within a time limit; if it fails to make corrections within the time limit, a fine of not less than 5,000 yuan but not more than 50,000 yuan will be imposed.
Article 27 If a mulch film user violates the provisions of these regulations and fails to recycle non-biodegradable waste mulch film in accordance with the regulations, the agricultural products of the people’s government at or above the banner and county level shall be punished. The animal husbandry department shall order correction and impose a fine of not less than 10,000 yuan but not more than 100,000 yuan; if the mulch film user is an individual, a fine of not less than 200 yuan but not more than 2,000 yuan may be imposed.
Article 28 In violation of the provisions of these regulations, agricultural film recycling enterprises, recycling outlets or other organizations obtain money by forging ledgers, falsely reporting quantities, etc. In the case of financial subsidy funds, the agricultural and animal husbandry departments of the people’s governments at or above the banner and county level shall recover the financial subsidy funds, record them in credit records in accordance with laws and regulations, and make them public; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
Article 29 If anyone neglects his duties, abuses his power or engages in malpractice for personal gain in the prevention and control of agricultural film pollution, the directly responsible person in charge and other directly responsible personnel Punishments shall be imposed in accordance with the law; if a crime is constituted, criminal liability shall be pursued in accordance with the law.
